Rules and Regulations
Management of the Muddy Creek Cemetery shall be under the direction of the Board of Directors.
All cemetery maintenance, including marking of the grave openings, will be carried out under the Board of Directors’ direction.
Funds needed for the further development and maintenance of the cemetery shall be provided for by income from investments, the sale of burial and cremation lots, contributions from lot owners and other interested persons, and bequests.
All cemetery-related expenses shall be approved by the Board of Directors and paid by Secretary/Treasurer of the Board from the appropriate cemetery account.
Burial lots may be purchased by any member of Muddy Creek Lutheran Church and Peace United Church of Christ for their own use, family members, and such other persons they choose to admit. Non-members may purchase burial lots for themselves or immediate family members. Burial lot prices may be subject to change without advance notice.
The cemetery will not buy back previously purchased lots. Lots can be transferred privately with the original deed and written notice to the cemetery board. A fee will apply for the issuance of the new deed.
No grave shall be opened until the lot has been paid for unless authorized by a Director.
Ground-level corner posts marking the boundaries of lots may be installed at the owner's request and expense. Any corner posts must be installed under the direction of the Board of Directors.
All graves must be dug by a contractor hired by the Board of Directors. All burial vaults must be of concrete, steel, or heavy-duty plastic construction and with the top of the vault at least three feet below the surrounding ground elevation. Vaults are not required for cremated remains. Cremated remains must be in a container suitable for burial.
All foundations must be set by a contractor specified by the Board of Directors.
All foundations will be flush with ground level at the highest point.
Bronze plate markers must be flush with the surrounding grave.
No grave markers or tombstones shall project more than four feet above the ground at the highest ground level. No grave marker of the blanket type or covering the entire grave will be permitted. Requests for non-traditional memorials must be brought to the Board of Directors for approval.
No planting of trees, shrubbery, or flowers of any kind is permitted on burial lots in the cemetery. All flowers should be removed after they have lost their beauty. No other permanent accessories on gravesites, except military markers, are permitted. At appropriate periods throughout the year, the Board of Directors reserves the right to without notice remove any decorations or other items for appropriate maintenance and to ensure the beauty and dignity of the cemetery.
All cemetery records of lot owners, burial lists, and charts shall be kept by the Board of Directors and transferred to new officers whenever a change in cemetery officers occurs.
No disinterment will be allowed without the consent of the Board of Directors.
Multiple burials on one regular burial lot (such as multiple cremations or cremated remains on top of a regular burial) are permitted. Double-depth burials are not permitted. Up to 4 cremations can be placed on top of a traditional burial if space permits. An additional fee will apply to any burials after the 2nd burial on a plot, due at the time of burial.
For any burial to take place in the cemetery, the deed holder for the plot must approve, unless the cemetery records indicate who will be placed in that lot. Deed holders are encouraged to contact the cemetery board with requests to reserve lots for specific individuals.
Charges for a grave opening/closing will be set by the Board of Directors and are subject to change without notice. Extra charges will be assessed for a weekend and holiday grave opening/closing, multiple grave openings/closings, rock removal, snow removal, cutting frost, and other special conditions.
The scattering of ashes on cemetery property is not permitted.
These regulations are subject to change as deemed appropriate by the Board of Directors.
